smartHA Not to Be Used for a Medical Emergency.
If you have a medical emergency, you should immediately go to your nearest emergency room or dial 100 (emergency) or 102 (Ambulance) and you should not attempt to communicate with your provider through smartHA, as there may be a delay of several days or more before your provider can respond to your concern. There is no guarantee any specific response times to inquiries submitted through smartHA.
What This Site Offers
This online site called smartHA is a service of the RenovLife Health Technologies LLP and is designed to offer health and medical information to registered users. In addition to providing smartHA to RenovLife's own members, RenovLife also provides smartHA as a contracted service to independent, third-party health care facilities and providers ("Independent Health Provider").
If you are accessing smartHA as a patient or member of an Independent Provider, RenovLife Health Technologies LLP is not responsible, and does not assume any liability, for any actions or omissions, including those related to treatment, of the Independent Provider. RenovLife Health Technologies LLP is not responsible for the accuracy and/or completeness of any information entered into smartHA by your Independent Health Provider. As a result, all information provided to you through smartHA that is generated by an Independent Health Provider is provided AS IS. All patients and members who use smartHA are subject to these requirements which are referred to as the "Conditions of Use." When the term "you" is used, it refers to the person who is authorized to access the patient's medical information. In most cases this will be only the patient himself or herself, but adults will often have access to medical information for a minor child, and in some cases adults may have access to a smartHA account for another adult due to disability or incapacity. The term "your Independent Health Provider " refers to your treating provider, which may be health care facilities and/or your Independent Provider, as applicable.
At this time we anticipate that smartHA will primarily be useful for the following types of activities:
1) Making, reviewing, or cancelling appointments.
2) Viewing selected portions of your medical record such as allergies, medications, histories, problem list, and recent visit information.
3) Receiving certain lab results.
4) Communicating with your Health Care Provider via secure messaging regarding health concerns.
5) Requesting prescription refills and prescription renewals.
6) Finding links to other sites that will provide health information.
Users who are RenovLife members will have the ability to:
7) View benefit information and check out-of-pocket benefits
8) Check claim status and print EOBs
9) Check eligibility
10) Print temporary wallets cards
11) Grant access control to members on your plan, if you so choose
Your Health Care Provider will endeavor to provide a timely response to electronic inquiries. In some cases, your Health Care Provider's clinic staff who need to respond may not be immediately available so you should allow at least three (3) business days for a response. Please note that there is no guarantee of any specific response times to inquiries submitted through smartHA.
Read These Conditions of Use before Using smartHA
It is recommended that you thoroughly review and understand the Conditions of Use prior to using smartHA. If you have any questions or concerns, please talk to your Health Care Provider's staff about your questions before using smartHA. By using smartHA, including any links available through smartHA, you have agreed to abide by all of the terms and conditions of any linked sites as well as these Conditions of Use.
Copyrights, Trademarks, Service Marks, and Other Intellectual Property
The marks "RenovLife", and all related marks and logos are protected trademarks of the RenovLife. Similarly, any marks of Independent Providers, such as "Carson Tahoe Health" are protected. In addition, the content of smartHA is protected by copyright. You may access the content of smartHA only for your personal, noncommercial use. If you desire to reproduce or download any part of the content for other than personal use, you must request and receive written permission from RenovLife before doing so.
Private Information on This Service
For information regarding the use, disclosure, and protection of personally identifiable information pertaining to smartHA, see the Notice of Privacy Practices provided by your Health Care Provider. Contact your Health Care Provider for a printed copy of its Notice of Privacy Practices.
Links to Other Sites
Any links contained on smartHA are provided solely as a convenience to you. Neither RenovLife nor Independent Providers endorse nor make any representation regarding such third-party sites, their information, services, or merchandise.
Use of RenovLife Creates an Agreement
These Conditions of Use form an agreement between you, RenovLife, and Independent Providers that is entered into and is subject to the laws of the State. In the event of litigation relating from your use of smartHA, you agree that states’s will govern any such dispute and you agree to submit to the exclusive personal jurisdiction of the appropriate courts of the State, either federal or state.
Prohibited Use of smartHA
If you live in a state or country that has laws that would either (1) void or alter these Conditions of Use or (2) make illegal the access or use of smartHA, then your use of smartHA is unauthorized and your use of smartHA is at your own risk.
Computer Security
You understand that although RenovLife LLP has taken reasonable steps and has employed industry-standard practices and technology to ensure the integrity and confidentiality of any personally identifiable information available through smartHA, even the most secure system can be violated and that RenovLife cannot guarantee security. In addition, you understand that you are responsible to ensure that your computer has protections against viruses, malware, spyware, Trojan horses, and other types of problematic computer cookies, downloads, or software. RenovLife LLP and Independent Providers cannot guarantee that your use of smartHA will be free of such problems.
By using smartHA you agree that you will hold harmless, indemnify, and covenant not to sue RenovLife LLP or Independent Providers for any damage to your computer, laptop, software, or other computer system resulting from your use of smartHA.
You understand that registration and use of a personally-identifiable password is a prerequisite to participating in smartHA. You agree to use good judgment in the selection of a password, agree to not share this password with others, and you understand that the compromise of your password could allow personal information to become known to other parties. You agree that you are solely responsible for ensuring your password security. You agree to hold harmless, indemnify, and covenant not to sue RenovLife or Independent Providers for any injuries to you or your property (whether physical or psychological) you suffer from your failure to keep your password secure.
If you feel your personal information has been compromised, please contact your Health Care Provider.
Termination of Use of smartHA
Either you, RenovLife, or Independent Provider, at any time, may cancel participation in smartHA. You have no entitlement to continued use of smartHA. RenovLife may cease your access to smartHA for any reason related to RenovLife's business needs. You may contact your Health Care Provider at any time to request that your access to smartHA be terminated.
Nature of Communications with Your Health Care Provider
You understand that smartHA will allow you to communicate directly with your Health Care Provider regarding your medical care. You agree that you will only use smartHA to convey online messages of a non-urgent nature. You will only convey online messages that are suitable for communication in this medium. Some situations will be best handled either through a telephone conversation or an in-person visit. As described above, for any emergency conditions you should immediately go to your nearest emergency room or dial 911 immediately.
You also agree to communicate only through smartHA for your own medical condition or for the medical condition of someone for whom you are authorized to make medical decisions. You agree that asking for advice on behalf of another person for whom you are not authorized to make medical decisions could potentially be harmful and is a violation of these Conditions of Use.
Also, your Health Care Provider can only respond to the information you have provided. If the information you provide via smartHA is incomplete or inaccurate, it will not be possible for your Health Care Provider to provide a complete or accurate response. You are responsible for any incomplete or inaccurate communications resulting from your submission of incomplete or inaccurate information to your Health Care Provider or smartHA.
No Guarantee of Continuous Access to smartHA
RenovLife and Independent Providers cannot guarantee that use of smartHA will be free of interruptions. RenovLife regularly engages in routine maintenance of its computer systems, which may lead to inaccessibility of smartHA. In addition, factors beyond the control of RenovLife and Independent Providers, such as power outages, may lead to inaccessibility. During these times if it is necessary to contact your Health Care Provider you should do so by telephone or by an in-person visit.
No Guarantee of Completeness of Medical Record
smartHA is designed for your convenience and enhances your access to certain parts of your medical record. However, neither RenovLife nor Independent Providers guarantee that smartHA contains your complete medical record. In fact, there are certain types of medical information that will never appear in smartHA. If you want a complete copy of your medical record, you should contact your Health Care Provider by telephone or in person. Never assume that your smartHA record is your complete medical record or insurance information.
Messages exchanged between you and your Health Care Provider through smartHA become part of your official medical record. This information is confidential but may typically be released with your consent or by legal requirement. You agree to use appropriate discretion when sending online messages, particularly if you do not want the information to appear in the official medical record. If you do not want something to appear in the official medical record, do not submit it through smartHA.
Authorized Access by Your Health Care Provider
Any authorized person at your Health Care Provider who would otherwise be authorized to access your medical records may be authorized to view information submitted through your smartHA account.
Your Responsibility to Review smartHA Messages in a Timely Manner
Messages sent to you via smartHA might contain information that is important to your health and medical care. It is your responsibility to monitor these messages in a timely manner. You are liable for any loss, injury or claims of any kind resulting from messages that you fail to read in a timely manner.
As a user of smartHA you should be aware that you will be notified via e-mail when there is new medical information to be viewed on smartHA. This means that any person with access to your e-mail will be able to see this notification. This could include your family members, employer or anyone else who can access your e-mail account. Although no private medical information will be sent, the notification that new medical information is available may be information that you would not want others to know. You should take this into account when providing an e-mail address or using smartHA.
Proxy Access for Minors
All users of smartHA must be at least 18 years of age. Minors aged 12-17 may also use smartHA if the account is requested by the minor's parent or legal guardian. By using smartHA, you are representing that you are 18 years of age or older and possess the mental capacity to understand and agree to these Conditions of Use or in the case of a minor aged 12-17 a parent or legal guardian is representing that they are 18 years of age or older and possess the mental capacity to understand and agree to these Conditions of Use. Parents or guardians of minor children (age 0-17) may request access to the minor child's account by contacting the Health Care Provider where the minor is seen and requesting proxy access. Minor children between the ages of 12 and 17 (inclusive) may have limited information in their smartHA account available for review. Under State’s law, there are certain types of medical information that the parent or guardian of a minor patient may not view without the consent of the minor patient. Because of these requirements, we cannot offer a complete record in smartHA to parents of minor patients in this category. Thus, when a minor patient reaches age 12, proxy access is revoked and/or limited in scope.
In order to have proxy access for a minor's account or for the account for an adult with a disability (for example if you are the legal guardian for an adult), you must produce legal documentation to verify your legal standing and submit a copy to RenovLife through the proxy's Health Care Provider. Such access will only be granted to parties with parental rights or legal guardianship over the smartHA account holder and only to the extent that the party requesting proxy access can demonstrate the legal right to access the account holder's medical information. A smartHA account will be activated for both the proxy and the account holder. If the proxy's legal relationship with the account holder changes (for example if you are a legal guardian through foster care of a minor child but that child is legally adopted by someone else and your legal guardianship ceases), you must immediately notify the proxy's Health Care Provider.
Changes to the Conditions of Use
RenovLife may modify or change these Conditions of Use at any time. Such modifications or changes become effective immediately when they are posted to smartHA. You agree to review these Conditions of Use frequently so that you will be familiar with them. You further agree that each time you use smartHA you are, by such use, consenting to the Conditions of Use applicable at that time.
Use of Third-Party Services
You may choose to use other services provided by third parties in conjunction with your use of smartHA. Such services may include, but are not limited to, translation services, location services, and other third-party offerings. Any links to such services are provided for your convenience only. Neither RenovLife, or Independent Providers have control over the content of these services, and neither RenovLife nor Independent Providers accept any responsibility for them or for any loss or damage that may arise from your use of them. Such services may require you to submit your information to a third party, which may result in a copy of your information being used and/or stored by a third party. If you decide to access any such services in conjunction with your use of smartHA, you do so entirely at your own risk and subject to the terms and conditions of use for such services.
